PST: Red Bulls, United swap for Sandy

In what president Kevin Payne described as ?extraordinary circumstances,? D.C. United has lost home field advantage. Unfortunately, there weren?t very many alternatives for Major League Soccer, who this afternoon decided to swap the hosting assignments or United?s Eastern Conference semifinal against New York Red Bulls.

D.C. United, originally scheduled to host Wednesday?s second leg, are now home for Saturday?s series opener (8 p.m. Eastern, NBC Sports Network). New York gets the second leg next Wednesday, potentially benefitting from 30 minutes of extra time at home, should the teams finish even after the matchup?s first 180 minutes.

?This was a tough decision, but one that was much bigger than soccer,? league commissioner Don Garber said.

Thanks to Hurricane Sandy, Red Bull Arena is without power. Though the team is able to restore minimum functionality with the aid of generators, that functionality is insufficient to host a playoff game.

With the City of Harrison unable to determine exactly when full power would be restored, MLS has made the switch.

?I?m OK with it,? D.C. head coach Ben Olsen told The Washington Post. ?There are real issues in New York and New Jersey. People are suffering. This seemed to be the simplest solution.?

The simplest and perhaps only viable solution.

PPL Park in Philadelphia was considered, according to Garber, but that was a no go. Something like that couldn?t be thrown together on short notice, and instead of merely switching the order of matches, the solution would deprive New York (and their fans) of a game.

Rightfully, there?s been a lot of concern about D.C. losing their earned home-field advantage, having finished one spot above New York in the East. But in the face of tight schedules and television windows, nobody had a better solution. With each day that passed, ?wait and see? become more problematic.

It also shouldn?t be assumed that the first leg at home is an inherent disadvantage. In some circumstances, it can turn into a benefit.

Last season, Western Conference third seed Real Salt Lake blitzed Seattle in their semifinal?s home leg, taking a 3-0 lead out of Rio Tinto. Playing the first leg at home gives D.C. United a similar opportunity to take early control of the matchup.

Actress Taryn Manning charged with assault in NYC

NEW YORK (AP) ? Prosecutors say actress Taryn Manning attacked and choked her personal assistant in a New York City hotel room.

The New York Post (http://bit.ly/W2TAji ) and Daily News (http://nydn.us/TlxkKW ) report that Manning was arraigned Friday after an early morning fight the day before with assistant Holliann Hartman inside the Dream Hotel in Chelsea.

Manning is charged with misdemeanor assault.

She spent more than 24 hours locked up before she was released.

The 33-year-old Manning is best known for playing Eminem's ex-girlfriend in the 2002 movie "8 Mile."

Her lawyer, Joseph Tacopina, says Manning and the assistant got into a confrontation but it was not an assault. He says it was "a little misunderstanding between the two."

Manning is due back in court Nov. 13.

Iran's supreme leader vows to defeat sanctions, military threats and 'soft wars'

TEHRAN, Iran - Iran's supreme leader said Saturday that his country will defeat a combination of sanctions, military threats and "soft wars" launched by enemies trying to weaken Iran and force it to back down over its nuclear program.

Ayatollah Ali Khamenei's remarks, his third public speech in a week, came as tensions rise in the standoff between Iran and the West over Tehran's nuclear program.

They follow a precipitous decline in Iran's currency linked to economic sanctions imposed by the West, as well as remarks by Defence Secretary Leon Panetta highlighting the possibility of a cyberwar between Iran and the United States.

"We should not neglect the enemy. The enemy enters through various ways. One day it's talk of sanctions. Another day it's talk of military aggression. And one day, it's talk of soft war ... We have to be vigilant," state TV quoted Khamenei as saying during a speech in northeast Iran Saturday. "But they should rest assured that ... our enemies will fail in all their conspiracies and tricks."

The U.S. and its allies accuse Iran of using its civilian nuclear program as a cover to develop nuclear weapons. Tehran has denied the charges, saying its program is peaceful and geared toward generating electricity and producing radioisotopes to treat cancer patients.

The West are pursuing a two-pronged strategy that includes a mix of sanctions and diplomacy to try to force Tehran to halt uranium enrichment, a technology that can be used to produce nuclear fuel or materials for use in a warhead.

But the West has not ruled out the possibility of military strikes against Iranian nuclear facilities, and Panetta made a pointed warning on Thursday that the U.S. will strike back against a cyberattack, underscoring the Obama administration's growing concern that Iran could be the first country to unleash cyberterrorism on America.

Tehran for its part announces the discovery of computer viruses at nuclear, industrial and government sites. It blames the West and Israel. Israel has said little to deflect suspicion that it tries to infect some Iranian systems.

Iranian leaders have been consistently defiant, announcing measures they say the Islamic Republic is taking to evade sanctions, defeat cyberattacks, and prepare to repulse or retaliate for a military strike.

"Many politicians ... in the U.S., Britain and other countries ... employed all their might and designs with the assumption they could bring the Islamic Republic and the Iranian nation to its knees. They are gone and even their names are forgotten but the Iranian nation is present by the grace of God," Khamenei said.

Iranian leaders have also argued that it can always find customers for its oil and that the West is hurting itself, more than Iran, by cutting itself off from Iranian crude exports. Khamenei said Wednesday that European countries are "foolish" to support sanctions against Tehran, telling them they are sacrificing themselves for the sake of the United States.

But they also admit that sanctions are taking a bite.

Iran's currency ? already in steady decline for months ? lost nearly 40 per cent of its value earlier this month. It reached an all-time low of 35,500 to the dollar, down from 24,000 rials days earlier and close to 10,000 rials as recently as early 2011. It's now fluctuating between 29,000 rials to 32,000 rials in the open market. The decline set off limited, one-day protests in Tehran's market district.

The plummet of the rial was blamed on a combination of Iranian government mismanagement and the bite from tighter sanctions. Both measures have reduced the amount of foreign currency coming into the country.

Khamenei urged the nation to consume Iranian products and shun foreign goods to support domestic production.

"We should choose what we consume from among our own products. That some are always after foreign brands and names is wrong," he said. "Domestic consumption increases domestic production. When domestic production is increased, it will tackle unemployment and reduces inflation. These are all connected to each other."

French president outlines new approach to Africa

DAKAR, Senegal (AP) ? French President Francois Hollande attempted to make right France's relationship with Africa on Friday, honoring its contributions to world history during his first trip to the continent since winning office.

His deferential tone, his diplomatic remarks and the air of modesty he projected marked a dramatic contrast to his predecessor. Ex-President Nicolas Sarkozy came to Senegal five years ago and gave a speech that was viewed as deeply insulting to Africans whom he said had "not yet entered into history."

By contrast, the 58-year-old Hollande, who defeated Sarkozy in in May, described Senegal as having not only a "great country," but also one that had made important contributions to French history.

He reminded the audience at the whitewashed presidential palace, and later on the floor of the national assembly, that Senegal's first president, Leopold Sedar Senghor, was part of the committee that drafted the text of the French constitution. And he paid homage to the African soldiers, many conscripted by force, who died in France's imperial wars, including in Indochina and Algeria.

"Between France and Senegal, there's a history. There's a language that we both speak. There's a culture that we share and that both of our people contributed to," Hollande said in the garden of the neoclassical palace, in one of the many remarks that focused on the similarities between the two nations. "I didn't come to Africa to impose my way, or to deliver a lesson on morality," he added later, in a speech to parliament. "I consider Africans as my partners and as my friends."

Analysts say he chose Senegal for his first visit to the continent due to the country's democratic credentials and because of the need to heal the damage inflicted five years ago. He also chose it because Senegal is expected to play a central role in the planned military intervention in neighboring Mali, whose north is now under the de facto control of al-Qaida-linked rebel groups.

"What is happening in the Sahel for the past several months ? in Mali ? is that terrorists have structured themselves, have installed themselves. It's not simply a menace for West Africa," said Hollande. "It's a major issue for the security of the entire continent ? and Europe," he said.

Pushed by France, the United Nations Security Council is scheduled to vote Friday on a plan to back an African-led military intervention in northern Mali. Accompanying the president in Dakar on Friday, French Foreign Minister Laurent Fabius appeared confident the resolution would pass.

"If no one is against it ... it is already approved, and the window expires in the next few hours. So we can say that this hurdle has already been surmounted," he told reporters.

For the Senegalese though, what is front and center is the memory of Sarkozy's 2007 speech which bruised egos across the continent.

"The drama of Africa is that the African man has not fully entered into history ... They have never really launched themselves into the future," Sarkozy said. "The African peasant only knew the eternal renewal of time, marked by the endless repetition of the same gestures. ... In this universe where nature rules everything ... there is neither room for human endeavor nor the idea of progress."

He was accused of arrogance, of racism and of perpetuating the colonial relationship with Africa. Shocked, some of the people attending his speech delivered at Dakar's largest public university grabbed their bags and walked out.

"Sarkozy came with contempt. Hollande is coming to clean up," says Yero Dia, a political analyst who is a frequent commentator on TV debate shows in Senegal. "But for me it's not about Sarkozy, nor about Hollande. It's about us ? Africans. It's like the horse and the rider. Whether it's Mitterand, or Chirac, or Sarkozy or Hollande, what remains constant is the system. ... and nothing will change until Africans stop behaving like the horse and letting France be their rider."

Senegal was once the seat of the French empire in West Africa. The country won its independence from France 52 years ago, but maintains close ties with France, as do many of the other countries on the French-speaking coast of West Africa, most of which are former French territories.

Ironically in 2007, Sarkozy had come to Senegal to mark the end of "Franceafrique," the term used to connote the cozy, post-colonial relationship that France has had with the region's dictators, like ex-Gabonese President Omar Bongo. On Friday, it was Hollande who vowed the end of Franceafrique.

"I want to declare here my willingness to renew the relationship between France and Africa. The era of Franceafrique is over. There is now a France and there is an Africa. And there is a partnership between France and Africa, based on relationships that are founded on respect," he said.

Hollande and Senegalese President Macky Sall also paid a visit to Goree Island, off the coast of the capital, where slaves were boarded onto ships headed to the New World. The visit is a symbolic gesture, underscoring Hollande's understanding of the difficult, and often cruel, history that Africans have endured. The two men clasped hands as they stood at the Door of No Return.

Among those waiting on the island for the presidents was Aminata Ba, 40, who wore a bright tangerine dress and head wrap, and carried a stenciled sign that read: "President Hollande: You Are At Home." She said she was heartened by Hollande's talk of improving relations with Senegal.

Africa watchers say that despite the promises of a new approach, it's unlikely that France's policies toward the continent will change much. Protesters waited for the leader to emerge from the parliament building on Friday, hoping to give him a copy of their fliers decrying the difficulty in getting visas to go to France. Immigrants who violate the terms of their visas have been returned on repatriation flights, dubbed the "Sarkozy charters."

"It seems that every time that a new French president comes in, he promises that his arrival will spell the end of Franceafrique," said Richard Downie, deputy director for the Washington-based Center for Strategic and International Studies. "Old habits die hard. In policy terms, will we see much difference? I think not. But I think the tone will be different."

WASHINGTON (AP) ? President Barack Obama is hailing the rebound of the U.S. auto industry, pointing to progress since his administration rescued General Motors and Chrysler.

Obama says in his weekly radio and Internet address that auto sales are the highest they've been in more than four years and the industry has created nearly a quarter of a million new jobs.

Automakers are large employers in Ohio, one of the pivotal states in the race between Obama and Republican Mitt Romney.

Markwayne Mullin, an Oklahoma Republican running for Congress, says in the GOP address that the Obama administration has pushed regulations that make it difficult for businesses.

He says the economy "doesn't need more meddling ? it needs more certainty."

Facebook to ask your OK before sharing actions

Tired of Facebook sharing every little article you read or song you?listen to, using its "Open Graph" system? So is Facebook, apparently.?Apps will soon need user permission to share "like," "follow," "listen," "read" or "watch" actions, according to product engineer Henry Zhang, who posted the new rules on?Facebook's developer blog.

"In order to provide users with experiences that meet their expectations, we will no longer approve custom actions that publish stories as people consume content," he wrote. "These apps must use the appropriate?built-in actions?or create a different sharing experience."

"Apps that help people automatically share stories about content as they consume it, such as the music you are listening to, can be good experiences when apps create clear expectations for the user of what is being shared and when," Zhang wrote. "When apps automatically publish stories on a person?s behalf in a way that is unexpected, such as when they browse an online store, it can surprise and confuse people."

The change is to take place "in the next 90 days," Zhang said.

Meanwhile, Facebook stories that lead with images and location are being made "more prominent" in Facebook's news feeds and Timeline, Zhang said.

"In early tests, the new image-led stories have shown 70 percent more clicks for apps that provide high quality, relevant imagery with low spam rates," Zhang wrote. "In certain cases, we have seen these stories generate up to 50x more Likes than equivalent story types from before. The new location stories provide double-digit gains in distribution to apps."

The Open Graph?changes may be welcome, but they're not totally altruistic: Facebook will annoy fewer of its users, but its goal is probably to be better "liked" by the Federal Trade Commission. The agency?recently settled charges with Facebook over deceiving consumers and making them share more personal info they they intended.

The settlement requires Facebook to get user consent for?some changes to privacy settings, and also subjects the site to 20 years of independent audits.

On Thursday night, L.A. Reid and Britney Spears had the opportunity to listen to their assigned categories perform at their homes. Well, homes that we'll just pretend are theirs since?The X Factor has recently admitted that the homes featured in the show are not necessarily the homes of the judges. Their reasoning for misleading viewers is that this portion of the show is called the "judges' homes" so they have to pretend that the homes are those of the judges. So, lying to the viewers is okay as long as you're lying to perpetuate the lie you started when you named a portion of the show.

Got it.

Now that we've cleared that up, let's discuss the contestants. To say that the teens wiped the floor with the "Over 25" category would simply not be true. The teens have wiped the floor of every other category on the show this season and last. Period. When Beatrice Miller and Carly Rose Sonenclar performed for Britney Spears and will.i.am, a miracle occurred: The X Factor, simply by virtue of discovering those two young artists, was forgiven its past transgressions. By adding Diamond White and Reed Deming to the mix, they have managed to bank forgiveness for transgressions they have yet to make.

The strength of the teen category might be the reason that L.A. Reid is so terribly disgusted with being assigned the "over 25" category. Well, that and the fact that Tara Simon is in the "over 25" category; who wouldn't throw a temper tantrum if they were forced to listen to her obnoxious vocal acrobats? Despite Tara's performance, Reid started to change his tune in the latter part of the episode, supposedly because he started to realize that his category, old and decrepit as they may be, might actually have some talent. (Although some would argue that it was actually Justin Bieber's soothing and angelic presence that mollified L.A.).

But it wasn't just obvious from their performances Thursday night that some of the over 25's have legitimate talent. In fact, L.A. Reid was very enthusiastic in his praise of both Jason Brock and David Correy during their auditions so when he described the "over 25's" as the underdogs in the competition tonight, it was perplexing. The stronger of the "over 25's," namely Jason Brock, Tate Stevens, Vino Alan and David Correy all?delivered quality performances though it was David Correy who stood out the most amongst them with his rendition of Jessie J's "Domino."?But even Correy's performance could not contradict the fact that Britney Spears was blessed with the most talented category in the competition.

BERLIN (Reuters) - Germany's planned tax cuts could stabilize domestic demand and help stimulate the European economy, Chancellor Angela Merkel said on Thursday, noting the country was feeling the effect of economic collapse in southern Europe.

"It is our job to stimulate the European economy, including with planned tax cuts," she said at a press conference in Berlin with Hungary's Prime Minister Viktor Orban.

"We are trying hard to continue growth and keeping domestic demand high to import goods from other euro zone countries," she said.

Germany's upper house of parliament in May rejected government plans to reduce taxes by about 6 billion euros, which the opposition said would be irresponsible at a time of budget consolidation.

Asked about a demand by the International Monetary Fund that Greece be given more time to meet bailout conditions, Merkel said she would base her judgment on the report by the "troika" of international lenders.

Google LG Nexus 4 leaked again, this time in high ... - Know Your Cell











Just a day after news surfaced that the LG Nexus 4 would launch Oct. 29, more images of Google's upcoming Android smartphone have been posted online. This time the photos are high quality, revealing the device with perfect HD clarity for the very first time.

Obtained by Belrusian site Onliner, the images show us more than anything we've seen thus far. The device seems very thin and very large with the same on-screen buttons you all know and love. It also looks to feature LG's crystal reflection process on the back.?

Besides the photos, the site also indicates that tht the Google LG Nexus 4 will likely include a 4.7-inch HD IPS display, a quad-core 1.5GHz S4 Pro processor, an 8-megapixel camera, and 2GB of RAM. These specs all match up with Nexus details reported over the past few months and are exactly the same as those found on the LG Optimus G.

Lastly, in terms of software, Onliner says the LG Nexus 4 will run Android 4.1.2 at launch, not Android 4.2 as rumored. Onliner, suggests, however, that Android 4.2 could be on the way before the phone hits stores.

For now that is all the details and have, but considering the device looks to be final possibly, we should see more soon. Andy Rubin, Google's senior mobile VP, is expected to show off the latest Nexus at AllThingsD: Dive Into Mobile later this month.

Vice presidential debate could be a tale of two Ryans

ST. PETERSBURG, Florida (Reuters) - Republican Congressman Paul Ryan is a changed man. Presidential candidate Mitt Romney's running mate made a name for himself as a bold fiscal crusader, willing to make big, unpopular cuts to entitlements to get U.S. finances in order.

But since Romney tapped him in August to join his campaign, the vice presidential candidate has become more prudent, avoiding detailed discussion of his budget plan and earning the nickname "mini-Mitt" for displaying a cautious streak like his boss.

For Vice President Joe Biden, a major question heading into his debate with Ryan in Kentucky on Thursday is "a choice of which Ryan we're going to see," a Biden adviser said.

Instead of promoting his own budget plan, which includes caps on future Medicare spending, Ryan is talking up Romney's more voter-friendly version, which has no spending limits, at campaign events.

"The vice president has been studying up on (Ryan's) real positions and is prepared to call him out on his actual positions," said the adviser, who warned that "maybe there will be some dishonesty," from the Republican.

The stakes are high for Biden, who is charged with righting a listing ship after President Barack Obama's disastrous first debate against Romney in Denver last week, which lost him the momentum in polls ahead of the November 6 election.

Democrats have targeted Ryan's budget, a severe series of spending cuts, as proof that he would hurt seniors and the middle class.

One top Republican strategist said the best way for Biden to battle his opponent is to tease out the "wonky" Ryan, the congressman who loves mind-numbing fiscal details.

"If I was prepping against Ryan, I would be looking for issues that Romney and Ryan disagree on and try and pull out Ryan the wonk, as opposed to Ryan the running mate," the strategist said.

That would turn off television viewers not used to detailed policy arguments, and could give Biden a chance to paint the Republican team as holding different positions on Medicare.

The Romney campaign has worked overtime to emphasize that House Budget Committee chairman Ryan has fallen in line with the presidential candidate on fiscal issues.

"You have to remember this is a Romney-Ryan ticket, and there's one presidential candidate, there's one person at the top of the ticket," Romney spokesman Kevin Madden told reporters on Tuesday.

NO RYAN DOCTRINE

An image of Ryan as a congenial Midwesterner rather than a congressional budget hawk has been enhanced on the campaign trail, where he has worked to build a reputation for an easy manner with voters.

Much was made in the media of Ryan cutting short an interview this week with a local television reporter whose questions he did not like, but the Wisconsin congressman was in good spirits immediately after the interview, and did not storm off as was suggested.

Economic issues aside, Ryan is clearly taking his lead from Romney on foreign policy, a weak spot for the 42-year-old congressman against Biden, who spent more than 10 years on the Senate Foreign Relations Committee.

In Ohio on Monday, Ryan echoed much of the language and themes that the former Massachusetts governor laid out in an attack on Obama's handling of world events during a speech at the Virginia Military Institute.

"The president is not offering the kind of spirited and principled leadership we need to create jobs here at home or to keep us safe," Ryan said.

At a rally, he pressed home criticism of Obama over the killing of four Americans in Libya, a favorite foreign policy attack line of Romney.

Ryan told voters to just turn on their televisions: "You will likely see the failures of the Obama foreign policy unfolding before our eyes," Ryan said. "You see if you look around the world, what we are witnessing is the unraveling of the Obama foreign policy."

Leading up to Thursday's debate, Ryan retreated to Florida to prepare, spending Tuesday morning focused on policy briefings before switching to debate prep.

Ryan aides in recent days have begun the typical campaign ritual of playing up your opponent before a debate, portraying Biden as a seasoned professional.

"Vice President Biden has done 18 presidential or VP debates over the years - 14 in 2008," said one Ryan aide. "He's always a focused debater. It's not a setting in which he makes gaffes."

Brendan Buck, a Ryan spokesman, noted that Thursday night will be Ryan's "first time on the big stage."

"After the president's performance last week, we know Joe Biden will (be) coming at us like a cannonball," Buck said.

A recent article on the MyPRGenie blog about where to find great images without copyright hassle generated a lot of buzz on Twitter.? One person, however, posed the question, ?I?m in PR ? if I?d wanted to go to law school, it would have made my parents happy.? Why do I need to understand legal issues to do my job?? Miranda Tan, CEO of MyPRGenie, replied, ?The short answer is that litigation, especially around social media, is increasing for all marketers.? Copyright ? for images, music, trademarks, and content ? is one of the major contributors to the rise in the legal headaches PR people and marketers face.? Take the recent case of the Michigan PR firm that created a public service campaign.? They thought they?d done everything right, getting permission to use a popular song, and when the video made it debut at an NFL game, it soon went viral, with more than 2 million hits in the first few days. That?s when a so-called ?secondary rights holder? had the video removed from YouTube for copyright infringement, bringing the campaign to a screeching halt while the parties negotiated permissions, payments, and other legal issues. But, Tan says, copyright isn?t the only potential litigation threat that PR and social media marketing professionals face.? Here?s a list of five other legal questions to answer for yourself and your content before your next post. Issue #2: Who Owns Social Media Accounts? One of the most contentious areas in social media litigation is the ownership of social media accounts and content.? From lawsuits over LinkedIn contacts?to disputes about Twitter accounts?to wrangles over employee adherence to social media policies, this is the fastest growing area of legal troubles for all marketers. If you have an existing social media account before you take a PR job, and you will be using that account to post or share information for your new client or employer, make sure that the ownership of the existing social media account is spelled out before the first post is made.? And if you?re starting a social media campaign for a new client or employer, seriously consider setting up a new account ? something like PRGenieJohnny ? to separate your work account from your personal JohnnyADoe?account. Issue #3:?What Government Regulations Matter? If you work in a heavily regulated industry ? banking, education, financial services, government, health care, insurance, medicine, pharmaceuticals ? chances are you already know that your PR, marketing, and social media messages are subject to rules from an alphabet soup list of regulatory agencies. But the word hasn?t gotten out as widely as it might have ? the people most likely to be fired (or even prosecuted) for online comments are still public service employees (teachers, teacher?s aides, nurses, police and firefighters), most of them posting what they thought were comments protected by the First Amendment. But there are other federal and state rules that affect everyone online, such as CAN-SPAM (which DOES apply to Twitter?and Facebook direct messages, not just to email) and Federal Trade Commission rules on truth-in-advertising.? Do you have an auto-responder set in your Tweet scheduling app to thank people who follow you, and suggest that they also like you on Facebook ? or download something?? Does that constitute ?spam???For now, it?s up to each user to decide whether to report a direct message to Twitter as spam. One area of government regulation that is getting a lot of companies into trouble these days is the National Labor Relations Board stance on social media policies.? For instance, many companies have long had policies that prohibited employees from commenting on pending litigation, disparaging the company or its products, or criticizing management ? but even if your firm is a non-union shop in a right-to-work state, these policies may violate rules intended to protect employees who want to unionize.? Some lawyers have never heard of the right of publicity ? until one of their clients gets into trouble for violating it.? ?Simply restated, the right of publicity is the right of every person to control the way their ?name, voice, signature, photograph, image, likeness, distinctive appearance, gestures or mannerisms? are used. It?s the right of publicity ? not the right of privacy ? that comes into play in the so-called Streisand Rule about publishing images of a celebrity?s home, and it?s the right of publicity that makes posting photos of your employees, guests at a fund-raiser, or customers at your business, problematic. Sometimes, getting permission before you post an image, a comment, or (especially) a video can be the most important step in planning a social media or PR campaign. Issue #5:??How Do I Protect Myself? If you?re like most people confronted with a list of things that can get you sued or fined, your first reaction is to question whether or not it?s worth it to take the risk.? When it comes to social media and PR, there?s no question that they?re among the most cost-effective ways to market your company?s products and services ? and opting out of either one isn?t really an option. So the question becomes one of protecting yourself and your company, and the best advice we can offer is simple:? understand the rules, and minimize your risk by following them. Three important steps can minimize the risks:

  • Create a social media policy, train employees on following the policy, and enforce it evenly and fairly.
  • Involve legal and compliance teams in your PR and social media planning process, especially if it?s a new area for the company.
  • Purchase Cyber Insurance to protect your assets.

Cyber Insurance not only protects in the event of litigation, but most policies come with an audit that helps you see where the current risks are, and outlines steps you can take to minimize them.? It usually also protects in the event of a hacking or security breach ? a separate risk that rapidly growing businesses (especially those that accept credit cards or store customer data in the cloud) need to consider.

Race between Romney, Obama still all about Ohio

COLUMBUS, Ohio (AP) ? It's still all about Ohio.

After a strong debate performance, Republican challenger Mitt Romney is intensifying his efforts in the state that's critical to his White House hopes, while President Barack Obama works to hang on to the polling edge he's had here for weeks.

Both candidates campaigned hard in the state Tuesday, the last day of voter registration ahead of Election Day, now just four weeks away.

"It's time for him to leave the White House," Romney said of Obama at an evening rally in Cuyahoga Falls. "Ohio's going to elect me the next president of the United States."

Obama, in Columbus, called out, "All right, Buckeyes, we need you." His campaign had buses nearby, ready to ferry students or other supporters to registration centers.

As Obama wooed Ohio State University students here and Romney focused on the Democratic bastion of Cuyahoga County to the north, there were signs the president's Ohio advantage was narrowing. A new CNN poll showed Obama leading Romney 51 percent to 47 percent among likely Ohio voters. And Republican strategists familiar with Romney's internal polling contended the race was even closer ? within a single percentage point ? as the candidate enjoyed a post-debate surge of support.

"I promise you he's back in the game in Ohio," said Charlie Black, an informal Romney campaign adviser.

Like other Republicans, he credits Romney's strong debate appearance last week as the reason for an uptick in national polling. And Romney advisers maintain they're seeing evidence of that in the battleground states most likely to decide the election, Ohio among them.

"There isn't any question that he has breathed new life and new energy into the Republican Party," Ohio Gov. John Kasich said Tuesday on a conference call with reporters. "We're seeing that there is greater intensity among Republicans and a great willingness to get out and vote and participate than we're seeing with Democrats."

With a hefty 18 electoral votes, Ohio is such a key state for Romney that one top adviser has dubbed it "the ball game" as the Republican looks to string together enough state victories to amass the 270 Electoral College votes needed to take the White House. No Republican has won the presidency without this Midwestern state, and if Romney were to lose here, he would have to carry every other battleground state except tiny New Hampshire.

Romney has far fewer state-by-state paths to the White House than Obama, who still has several routes to victory should he lose here.

Given the stakes and with just 28 days left in the campaign, Romney's schedule highlights his increased focus on the state: He's spending four of the next five days in Ohio, ahead of the second presidential debate in New York next Tuesday. Running mate Paul Ryan squares off against Vice President Joe Biden on Thursday for the sole debate featuring the No. 2's on the tickets.

Obama was being greeted in Columbus ? for a rally at Ohio State University ? by enormous letters that spelled out "vote early," a plea to the young voters who buoyed the president's bid in 2008. He arrived from the West Coast, where he had been raising millions of dollars for the campaign.

Obama campaign spokeswoman Jen Psaki dismissed the impact of polls showing a tighter race, saying Democrats always expected the race here and elsewhere to tighten ahead of Election Day.

"We have blinders on," she told reporters traveling on Air Force One. "We're implementing our own game plan."

Illustrating the competitive nature of Ohio, no presidential battleground has been more saturated with television advertising.

The campaigns and outside groups had spent more than $141 million on TV ads in Ohio through the beginning of October, one of the highest per-person spending rates in the country. Only more-populous Florida, which has seen $150 million in ad spending, has seen a higher total.

Ads in Ohio have focused on the energy industry ? some rural, southern areas of the state rely heavily on coal ? and on China, where foreign companies are seen as competing with Ohio's manufacturing base and jeopardizing jobs.

Obama has sought to paint Romney as a plutocrat who outsourced jobs during his tenure leading the private equity firm Bain Capital.

Romney, in turn, has sharply criticized Obama's support for stricter regulations on coal and natural gas. It's seen as a way in with white working-class voters, on which his candidacy depends. "Stop the War on Coal. Fire Obama," read signs that dot the countryside of areas where Romney has held multiple events.

White blue-collar workers prefer Romney to Obama, but less so than they did Republican George W. Bush, who carried Ohio in 2004. These voters are considered still persuadable, although Romney may have hurt himself with his comment that the 47 percent of Americans who pay no income tax believe they are victims entitled to government help.

Romney's position on the auto bailout also dogs him in a state that's heavily reliant on the industry. Obama's decision to offer government support to automakers meant protection for thousands of jobs at parts and supply companies in Ohio.

Romney wrote a 2008 op-ed headlined "Let Detroit Go Bankrupt," which has become a rallying cry for Democrats. They have argued Obama's support for the bailout has had a hand in Ohio's drop in unemployment, which is now lower than the national average.

In the final weeks, both campaigns insist they have the edge in the critical ground game. That battle was playing out in the courts, as well, with Ohio's election chief saying Tuesday he will appeal a ruling that reinstates the final three early voting days in the state.

Ohio Secretary of State Jon Husted called a decision last week by a federal appeals court "an unprecedented intrusion" into how states run elections.

Husted said Friday's decision by the 6th U.S. Circuit Court of Appeals would affect how elections are run in all 50 states. The appeals court in Cincinnati affirmed a lower court ruling and returned discretion to set hours on the final three days to local boards of elections.

U.S. lawmakers seek to block China Huawei, ZTE U.S. inroads

WASHINGTON (Reuters) - U.S. telecommunications operators should not do business with China's top network equipment makers because potential Chinese state influence on the companies poses a security threat, the U.S. House of Representatives Intelligence Committee said in a report on Monday.

The report follows an 11-month investigation by the committee into Huawei Technologies Co Ltd and its smaller rival, ZTE Corp.

The companies have been fighting an uphill battle to overcome U.S. lawmakers' suspicions and expand in the United States after becoming key players in the worldwide market.

The House Intelligence Committee's bipartisan concerns are bound to set back the companies' U.S. prospects and may also lead to new strains in trade ties between the United States and China, the world's two biggest economies.

Committee Chairman Mike Rogers, at a press conference to release the report, said companies that had used Huawei equipment had reported "numerous allegations" of unexpected behavior, including routers supposedly sending large data packs to China late at night.

The panel cited what it called long-term security risks supposedly linked with the companies' equipment and services. It did not provide any hard evidence to back up its concerns, at least not in the unclassified version of the report.

Rogers, a Michigan Republican who is a former FBI agent, said lawmakers' concerns had been heightened by what he and the panel's top Democrat, C.A. Ruppersberger of Maryland, described as the companies' lack of full cooperation with the investigation.

If the committee's warnings about doing business with Huawei and ZTE prompt the Chinese government to get out of the business of cyber espionage, a growing U.S. concern, "then that's great," he added.

The committee recommended that the Committee on Foreign Investment in the United States, an inter-agency group that evaluates the national security risks of foreign investments, should block any deals involving Huawei or ZTE.

Government contractors and private-sector companies should seek other vendors for their network equipment, the panel said.

Rogers, responding to a question at the press conference, stopped short of urging a U.S. boycott of mobile phones and other handheld devices made by Huawei and ZTE.

The panel's warning pertains only to devices that involve processing of data on a large scale, he said, not Huawei- and ZTE-made mobile phones.

Employee-owned Huawei is the world's second-biggest maker of routers, switches and other telecommunications equipment after Sweden's Ericsson. ZTE ranks fifth.

The panel said it had received credible allegations suggesting Huawei may be guilty of bribery and corruption, discriminatory behavior and copyright infringement.

Such allegations will be referred to the Justice Department and Department of Homeland Security for investigation, the panel said. A spokesman for the Justice Department, Dean Boyd, declined to comment.

'RUMORS AND SPECULATIONS'

The committee's warning comes as Huawei weighs a possible initial public offering, sources said, as part of an effort to overcome suspicions that have all but blocked its U.S. efforts, including business tie-ins.

Huawei denounced the findings, which it said "employs many rumors and speculations to prove non-existent accusations."

"We have to suspect that the only purpose of such a report is to impede competition and obstruct Chinese (telecom) companies from entering the U.S. market," Huawei said.

ZTE, in a newly released copy of a letter to the committee, said it "profoundly disagrees" with allegations that it is directed or controlled by the Chinese government.

"ZTE should not be a focus of this investigation to the exclusion of the much larger Western vendors," it said.

Zeus Kerravala, a networking equipment analyst at ZK research, said the effect of the congressional probe was to hand the market to Ericsson and Altactel-Lucent because he does not see any U.S. firm able to compete, for instance, with wireless technology.

ZTE's Hong Kong-listed shares fell as much as 3.4 percent early on Monday.

Huawei's U.S. sales totaled $1.3 billion last year, a small fraction of its worldwide sales of $32.4 billion. Handheld devices accounted for about three-fourths of Huawei sales in the United States last year, including via T-Mobile, AT&T and Sprint.

ZTE's U.S. telecom infrastructure equipment sales last year were less than $30 million. In contrast, two of the larger Western vendors alone had combined U.S. sales that topped $14 billion, ZTE has said, alluding to Espoo, Finland-based Nokia Siemens Networks and Paris-based Alcatel Lucent.

GLOBAL PLAYERS

Huawei and ZTE, which are both based in Shenzhen, China, are rapidly becoming "dominant global players" in the telecommunications market, the report said. It noted that telecoms are intertwined with computerized controls for electric power grids; banking and finance systems; gas, oil and water systems; and rail and shipping.

The National Counterintelligence Executive, a U.S. intelligence arm, said in a landmark public report a year ago that "Chinese actors are the world's most active and persistent perpetrators of economic espionage."

China has also been a frequent target on the campaign trail, with President Barack Obama and Republican challenger Mitt Romney both saying the United States needs to get tougher on China for alleged abusive trade practices.

The committee's report criticized Huawei and ZTE for failing to answer questions or provide documentation regarding their business activities in Iran. In the case of ZTE, the report said the company "consistently declined to comment on recent media reports that ZTE had sold export-controlled items to Iran."

Reuters reported in March and April that ZTE had sold banned U.S. computer equipment to Iran's largest telecom firm. ZTE also agreed last year to ship millions of dollars worth of additional U.S. tech products to a unit of the consortium that controls the telecom firm. The Reuters stories have sparked investigations by the Commerce Department and the Federal Bureau of Investigation.

In the wake of those allegations, Cisco Systems has ended a longstanding sales partnership with ZTE Corp.

"MEANS, OPPORTUNITY, MOTIVE"

Huawei and ZTE may not be the only companies that present a risk to U.S. infrastructure, the committee's report said, but they are the two largest Chinese-founded, Chinese-owned companies seeking to market critical network equipment in the United States.

Beijing has the "means, opportunity and motive" to use them to its own ends, it added.

The report underscores how little return Huawei in particular has gotten from its significant investment in lobbying in Washington after suffering a number of high-profile setbacks.

In 2008, Huawei and private equity firm Bain Capital were forced to give up their bid for 3Com Corp after a U.S. panel rejected the deal because of national security concerns. Then in 2011, the company was forced to relinquish plans to buy some assets from U.S. server technology firm 3Leaf after the Committee on Foreign Investment mandated that Huawei divest certain parts of the deal.

The company has brought on seven firms registered to lobby U.S. lawmakers, including APCO, Doyce Boesch and Fleishman-Hillard, according to forms filed under the lobbying disclosure act. That is up from four firms in 2011, two in 2010 and one in 2009.

Nord Stream Launches Second Pipeline

Just 30 months after the start of construction of its first pipeline, Nord Stream?s twin pipeline system came on stream today, on schedule and on budget.

International specialists worked around the clock under the most challenging conditions to construct the pipelines with a total weight of 4 million tonnes.

Nord Stream Managing Director Matthias Warnig said: ?We are proud of this incredible achievement, made possible thanks to the dedication of everyone at Nord Stream, the support of our shareholders, as well as, of suppliers and contractors from all over the world.?

Nord Stream?s second pipeline was officially inaugurated today, completing the fully-integrated twin-pipeline system. The Nord Stream pipeline system will provide the capacity to transport up to 55 billion cubic metres (bcm) of natural gas a year from Russia to the European Union for at least 50 years. Line 1 began transporting gas to Europe in November 2011.

Gerhard Schr?der, Chairman of the Nord Stream Shareholders? Committee said: ?Nord Stream is without a doubt one of the most modern systems for transporting energy ensuring that Europe enjoys a reliable supply from the world?s largest deposits in Russia. Today, we can proudly say ?We Deliver!?

To mark the occasion of both pipelines being fully operational, a ceremony was held today at Portovaya Bay, on Russia?s Baltic coast, in the presence of distinguished guests, representatives of several European countries and Nord Stream?s shareholders. By starting the gas flow in the control centre of the nearby Gazprom Compressor Station Portovaya, Russian gas can now be pumped without the need for interim re-compression all the way through the Baltic Sea, and onwards into the European gas transmission network. The state-of-the-art compressor units generate pressures of up to 220 bar, enough to take the gas through both 1,224 kilometre pipelines to Lubmin on the German Baltic Coast.

The precise routing of the pipelines had been agreed over a four-year period of intensive consultations with the nine countries bordering the Baltic Sea. Environmental monitoring results confirm the low environmental impact from the construction of the Nord Stream Pipelines.

Mr Warnig added: ?I am very pleased to report that we completed this ambitious infrastructure project on schedule and on budget. Looking at the number of other pipeline projects in various stages of planning in Europe ? Nord Stream certainly serves as the new benchmark. In terms of design, construction, safety, environmental compliance and the operation of our pipelines ? we truly deliver!?

Philippine BPOs court Democrats', Republicans' goodwill

MANILA, Philippines - With a rise in anti-outsourcing sentiment in the United States, firms are eager to rebrand the business process to make outsourcing to the Philippines more palatable to American Democrats and Republicans.

Since U.S. companies provide the clear majority of Philippine outsourcing work, winning over American support for the industry is imperative, explained Alfredo Ayala, Chairman of the Business Processing Association of the Philippines (BPAP) at an annual outsourcing summit on October 8.

"We want to make sure to keep the market leadership in the U.S.," said BPAP President and CEO Benedict Hernandez. "From a market perspective the U.S. is the biggest market in all categories. It's still dominating globally?. About 74% is the U.S. market (for) business. [About] 26% is the rest of the world."

Filipino firms are cautious not to outrightly support either candidate and say they are making efforts to talk to legislators on both sides of the aisle. The outcome of the election is still in question so Business Process Outsourcing (BPO) firms could be dealing with either candidate's policy platform for the next 4 years.

"I don't like the word 'lobbying.' I prefer the word 'dialogue.' I think we cannot ignore the fact that it is such a big part of the discussion in so much of the developed world's political economy. So it is incumbent on us to make sure people understand all sides of the discussion," said Ayala.

It's about changing the mindset towards outsourcing, he explained. "When you say technology, no one has a negative reaction to it, even though at the end of the day, it's technology that is probably quote-unquote the biggest destroyer of jobs. Things get more efficient and you do it in a different way. I think that would be the [goal], so people can view [outsourcing] objectively in terms of the pros and cons," said Ayala.

The outcome of the U.S. election in November is still in question so Business Process Outsourcing (BPO) firms could be dealing with either candidate's policy platform for the next 4 years. Outsourcing firms as far as India believe they should take the a bipartisan approach to courting more positive business sentiment, said Som Mittal, the President of the National Association of Software & Service Companies (NASSCOM), an organization of Indian information and technology business process outsourcing (IT-BPO) firms.

"For us our focus is business. We are all bipartisan. We have to be bipartisan right? It doesn't matter. We have thrived at a time when Republicans were in the seat. We have done well when Democrats have been (in power)," he said.

"From my vantage point, we work as much with the Democrats as with Republicans. And we have the same situation in our countries where we have multiple political parties at various federal and state levels. I don't think we as organizations would take sides on backing one or the other," he added.

A real need for good will

With the American election season underway with unemployment a crucial election issue, both parties' candidates have pointed the finger at outsourcing.

A central talking point of Barack Obama's campaign has been Mick Romney's involvement in Bain Capital, a private investment firm that Democrats say bought companies, laid off many American and sent their jobs abroad where they could pay less.

"You got to give Romney credit. He's a job creator - in Singapore, China, India. He's been very good at creating jobs, overseas," said Obama's Vice President, Joe Biden in June. ?

In July, Romney called Obama the real "outsourcer-in-chief" for giving stimulus funds to companies that "end up making their products outside the United States.

So far the sentiment has been confined to a word war and has not translated into new legislation, though a bill was put to the Senate to end existing tax breaks for employers who send their jobs overseas. The US Senate killed the bill by a 56-42 vote, not a long shot from the 60 votes needed to put the bill to a final vote.

"It's effecting economies that are not doing so well so when you say outsourcing (the mindset is) you're taking out our jobs instead of looking at it as a better service provider," acknowledged Mitch Locsin, Vice President And Head of Corporate Relationship Management for Philippine Long Distance Telephone Co. (PLDT).

Many BPO firms in the Philippines claim they make American businesses more cost effective. "We make U.S. companies more competitive" said Hernandez.

Local firms point out that many of the jobs that have gone abroad are in manufacturing, which is not a specialty of the Philippines. While some jobs have come back to the U.S., many haven't.

Philippine firms realize it's a sensitive subject for their former colonizer.

"We need to be very sensitive," said Hernandez.

"There are companies whose philosophy is, 'No, I am not going to ship out any jobs,' And that's their right," he said. "And our job as the delivery executer is to deliver really well so they know [they are getting the] value being paid for."

The negative connotations that these local firms have to combat are strong, especially during the election season.

"The changing of branding is going to be a tough job on finding the right niche of how it should be branded because it will still be affiliated with outsourcing no matter what," said Locsin. - Rappler.com
